1.Who operates the Phones 4u website

This website (www.phones4u.co.uk) is operated by Phones 4u Limited, a company incorporated in England and Wales with company registration number 03154198, whose registered office is at Osprey House, Ore Close, Lymedale Business Park, Newcastle-under-Lyme, Staffordshire, ST5 9QD, and references to “we”, “our” or "us" or "Phones 4u" refer to Phones 4u Limited.

If you make a purchase from this website, you are entering into a contract with Phones 4u Limited for the supply of the handset, USB dongle or laptop (as appropriate) and (other than where you are buying the goods on a standalone basis without a network contract) a contract with the relevant network provider for the supply of the network services.

2.General

The following are the terms and conditions (called "these Terms") for the supply of goods and services by us. We may change these Terms from time to time without notice to you. However, any changes will only apply to any orders received after the change.

We intend to rely upon these Terms. If you want to change them, please make sure you ask for any changes to be put in writing before you place your order. This is to avoid any misunderstandings as to what we and you are expected to do. It is important that you read and understand these Terms before ordering from us. If there is any term that you do not understand please notify our Customer Services Department before ordering from us. Our offers will have specific terms which are applicable to them and these will be explained to you by phone or on our website at the relevant page. All offers are valid only for the periods stated in the relevant advertisement or on the relevant web page.

The benefit of any contract entered into with us is personal to you and only you can enforce the contractual terms.

If any provision of these Terms is unenforceable this will not stop the rest of these Terms from being enforceable.

Even if we do not exercise any of our rights on a particular occasion, that will not prevent us exercising those rights in the future.

These Terms are governed by and construed in accordance with the laws of England and Wales. Each of us submits to the non-exclusive jurisdiction of the English Courts.

3.Supply of Phones, USB Modems and Laptops.

Unless we have specifically agreed to sell you a phone or laptop on a standalone basis we only agree to sell or supply a phone, USB modem or laptop (as appropriate) to you on the basis that you enter into an airtime agreement to connect the phone or USB modem we supply to an airtime provider for the specified minimum period on the particular network and tariff that is associated with the phone or USB modem. If there is a connection fee and/or a delivery charge, you must also pay that. The reason we insist on this is because mobile phones, USB modems and laptops can have a significant cost to us and we can only sell or supply a phone, USB modem or laptop either free or for a price far below what the item is worth (depending on the model or offer) if you also enter into such an airtime agreement. Your contract for airtime is not with us but is with a separate airtime provider

If we deliver a phone USB modem or laptop (as appropriate) to you (other than on a standalone basis) and you do not enter into the associated airtime agreement or you cancel your agreement AND do not return the phone USB modem or laptop (as appropriate) to us (or where permitted under paragraph 10 do not enable us to collect it) we will charge you the retail price of the items delivered to you. Our price list is on available on request.

The goods we deliver to you become your responsibility once they are delivered to you.

By offering to purchase goods and services you represent to us that you are 18 years of age or over for contract handset/SIM only/mobile broadband purchases, or 16 years of age or over for prepaid handsets/mobile broadband and authorise us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

The details on our websites or in our advertisements or contained in our marketing materials and activities are not offers that you can accept. All orders other than orders for goods on a standalone basis are subject to you passing any status and credit checks required by the airtime provider. Where you are paying any money for the goods, all orders are subject to obtaining payment authorisation from your credit or debit card provider. We will let you know if you do not pass these checks or if we do not obtain such authorisations

Except where you have ordered goods on a standalone or pay as you go basis, we will require a £1 deposit to be taken from your card account, which will be refunded on connection to your chosen network.

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order that you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we despatch the goods to you or commence the services; whichever is the earlier.

Prior to entering the contract, we will be under no obligation to supply you with the goods and/or services you have ordered.

We reserve the right to refuse or reject any order to obtain any goods or services at any time.

COMING SOON / ADVANCED ORDER

If you take advantage of our pre-order service, we require a £1 deposit on all pay-monthly products, which will be refunded on connection to your chosen network.

Stock availability on all coming soon/ advance orders are subject to date changes. The dates provided are estimated times of arrivals into our warehouse.

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail and you will have the option either to wait until the item is available from stock or to cancel your order. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order that you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and ourselves will take place when we despatch the goods to you or commence the services; whichever is the earlier.

CLEARANCE GOODS

Clearance goods are reconditioned and have been rigorously tested and fully refurbished by our engineers and re-packaged as new. All our clearance products are supplied with a 12-month warranty.

Any issues regarding faulty equipment should be directed to Phones 4u. This does not affect your statutory rights.

5. Price ...

If you have agreed to pay for goods during a telephone call with us, the price will be the price that we tell you during our telephone call. If you order from our website (unless we have made an error) the price will be the price quoted on the online order form.

If you have selected a "Bill Credit" tariff - Billing credits are a discount applied by Phones 4u to your monthly bill. Each month, you will have a discount applied, which will show as credit on your bill, you will still receive the advantages of the normal price plan but at a discounted rate. These credits will run for the agreed contract period. The Network will always try to apply the bill credits from your first bill however these can only be applied to a full months cycle (approximately 30 days) as all bills are pro-rata. We offer a variation of billing credits and contract lengths on selected deals, be sure you know what discount amount you will receive and contract length as this does vary.

Occasionally we may make a mistake in the price quoted on our website or in an advertisement and if we have made such an error, then we will inform you of this as soon as we become aware of it and will tell you the correct price and ask you if you still wish to place a new order with us. If we have not heard back from you within 10 days, then we will assume that you did not want to place a new order and we will give you a full refund if you have already paid.

We reserve the right to cancel the contract between us if one or more of the goods you ordered were listed at an incorrect price due to a typographical error or because of an error in our website. If we do cancel your contract in such circumstances, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

By ordering from us, you agree that we are authorised to charge your credit or debit card with the amount shown on the online order form or the amount we agree with you over the phone.

Once you are connected to your airtime provider, your first bill may not be for a complete month. The exact period will depend on the particular billing cycle that the airtime provider operates. We do not have any control over this but it does mean that any free minutes and/or free messages are pro rated from connection up until the date of your first bill. This means that you may not have your full minutes or texts and we recommend that you check this with your airtime provider upon receipt of the phone.

Your airtime provider's telephone number is included with the paperwork that will be sent to you with your phone.

If your contract with us includes a free gift, then the following terms will apply to your contract with us.

CASHBACK/DISCOUNTS BY REDEMPTION

  1. 1. Connection to a mobile phone network is subject to status, credit checking and entering into a service provider airtime contract.
  2. 2. To qualify for your Cashback, you must:
    a. Have a live contract with the network you were connected to at the time you purchased your qualifying contract mobile device and tariff.
    b. Have maintained continuous usage on this network and tariff up to and including the start of the qualification period.
    c. Have made full payment for the goods purchased at the point of connection.
  3. 3. Phones 4u cannot accept responsibility for applications lost or delayed in the post.
  4. 4. Proof of posting will not be accepted as proof of delivery.
  5. 5. All applications will be verified for eligibility upon receipt.
  6. 6. You should allow up to 30 days for your application to be processed.
  7. 7. Phones 4u accepts no tax liability incurred by an individual or business relating to this offer.

Samsung Galaxy S4 Pre-Order – Google Play Voucher Promotion

Overview

Offer is strictly whilst stock lasts, for customers pre-ordering the Samsung Galaxy S4, on a new contract, on 4GEE selected tariffs, through Phones 4u, subject to successful completion of the order, and for contract orders a credit check & connection to a new minimum term agreement.

Eligible customers will receive an E-Voucher of denomination GBP100, GBP50 or GBP25 Digital Google Play Promotional Credit depend on the Phones 4U tariff that the Customer purchases, as determined by Phones 4U*. E-voucher will be emailed to the customer within 28 days of the despatched of the handset.

The Promo Code will hold a GBP100, GBP50 or GBP25 promotional balance on Google Play (“Promotional Balance”) (funds will be deposited into the Customer’s Google Play account, which account will be required for redemption). One Promo Code will be provided per Phones 4U Device, such that a Customer who purchases two Phones 4U Devices will receive two separate E-Voucher Promo Codes. Part A: General Terms and Conditions

GOOGLE PLAY PROMOTIONAL BALANCE TERMS (UNITED KINGDOM)

The following terms apply generally to your use of Google Play promotional balances and promo codes. These terms are in addition to the terms of each Google Play promotion, which are displayed below. The terms are incorporated into the Terms as defined in the Google Play Terms of Service. In order to use a Google Play promotional balance you must have a Google Wallet account.

A. General Terms

  • Promotional balances are issued by Google Inc. Unused promotional balances expire on the date specified in your promotional balance offer. Google does not impose any fee on your use or maintenance of the promotional balance.
  • Your promotional balance is an offer of a discount off purchases, and does not have monetary value until it is used under the terms of the offer. It may be used for eligible purchases on Google Play only. It may not be used on other Google properties or third-party websites. Your Google Play promotional balance is a separate balance from any prepaid balance you may now or in the future associate with your Google Wallet account. Your Google Play promotional balance may not be combined by you with any prepaid balances in your Google Wallet account, transferred to other users or withdrawn for cash, is not reloadable, and has no cash value. Google Wallet may display your Google Play promotional balance as combined with other Google Play prepaid balances to show you the total value that can be purchased, for informational purposes only.
  • The expiration date of your redeemed promotional balance credit may be lengthened if you timely redeem more than one promotional balance offer into your Google Play account. In this instance, Google will terminate the prior offers, and apply the credit redeemed from prior offers to the terms of the most recently-redeemed promotional balance offer. Each subsequent redemption will expire the terms of any earlier redeemed offer, with the credit from the older offer being applied to the new offer terms, and with a new (later) expiration date applied to all redeemed promotional balance credits.
  • Your promotional balance may only be used as payment for an item you select for purchase on Google Play when your promotional balance is greater than or equal to the price of the item you wish to purchase on Google Play. We may, but are not required to, offer you the option in the future to purchase a Google Play prepaid balance, which may be applied to purchases along with any remainder of your promotional balance.
  • Upon making a selection from Google Play, any unused promotional balance will be applied to the purchase amount of your Google Play selection (prior to any available Google Play prepaid balance). You may continue to use your promotional balance for Google Play purchases until such balance is £0, or any remaining promotional balance expires, in accordance with these terms.
  • In the event you receive a refund of a purchase made with your promotional balance, any refunded amount will be credited back to your promotional balance for future use under these same terms.
  • Google may provide promotional offers and promo codes in coordination with other third party merchants for use on Google Play, which will be subject to these Terms of Service unless otherwise specified, subject to applicable law.
  • If you close your Google Wallet account, or Google chooses to no longer offer Google Wallet or Google Play, any remaining Google Play promotional balance associated with your Wallet account will be forfeited. If you change your country of residence, but keep your Wallet account dormant in the country which is no longer your primary residence, your promotional balance will expire per the terms of the agreement.

Part B: Specific Terms and Conditions

GOOGLE PLAY - PHONES 4U PROMOTIONAL CREDIT TERMS
(VERSION DATE: MARCH 21, 2013)

This Phones 4U Phones4u - Google Play Promotional Credit Offer is valid subject to the following terms. You must be a UK resident age 13 or older to participate, have an activated Google Wallet account, and have internet service (fees may apply). After purchase of an eligible Phones 4U device from Phones4u, you will receive an email from Phones 4U containing a code that, when redeemed on the redemption page on the Google Play store, will credit your Google Wallet account with a promotional balance. Credit can be used to purchase music, books, movies, magazines or apps on Google Play. You must enter the code on the redemption page on Google Play on or before May 31, 2013, or your code will expire. Once redeemed, any remaining promotional balance will expire if unused on or before Dec 31, 2013. Offer only applies to purchases of the Samsung Galaxy S4 from Phones 4u on 4GEE. 7.Delivery ...

Delivery Time Scales:

Here at Phones 4u, we know how much your phone means to you and for that reason we endeavour to deliver all online orders within 24-48 hours. We also don’t make you pay for delivery, so you won’t be hit with any hidden charges when your product is dispatched. However please be aware:

  • These timescales are dependent on stock availability, status and credit check. Stock availability will be indicated on the product page prior to purchasing.
  • We are only currently able to offer deliveries Monday to Friday (excluding bank holidays).
  • If we are unable to meet your delivery date requirements, we will contact you by email to provide you with an updated expected delivery date.
  • Please be aware that we do use third party companies for all deliveries and as such can’t guarantee exact delivery times and do not accept liability for any delays beyond our control (including delays by courier companies), or any delays which are caused by you.

Delivery Couriers:

All orders will be delivered by courier service DPD, except upgrades which will be sent out via Royal Mail Special Delivery.

Receiving Delivery of your order:

  • All free gifts will be delivered along with the handset unless specified otherwise (i.e. Games consoles, televisions, tablets etc)
  • All deliveries must be signed for. If no one is available to sign for the product then the courier may attempt to deliver to one of your neighbours. If no delivery is possible, a card will be left and parcel held at the local depot for you to collect or rearrange delivery. Parcels will be held for 5 days before they are returned to Phones 4 u. Please call the number specified on the card if you wish to re arrange delivery.
  • Be sure to check the condition of your package upon delivery and if it appears damaged we advise you not to accept delivery.
  • Always inspect the goods upon receipt. In the highly unlikely event that the wrong goods have been delivered or your items are defective or damaged, please inform us as soon as you can so we can rectify the situation.
  • We will not be liable for any delays beyond our reasonable control (including delays by courier companies) or any delays which are caused by you. If you delay a delivery, our responsibility for everything other than damage due to our negligence will end on the date we agreed to deliver it.
  • If for any reason we are unable to provide you with the goods you have ordered, we will ensure that you are contacted as soon as possible, at which point we will offer you the choice of accepting available substitute goods or a complete refund.

8. Your returns options

It's very unlikely that you will need to return any goods to us, and we certainly hope that you don’t have to. However, we do recognise that there are rare occasions when this is necessary so to help you in such an event, here is the detail of our returns policy.

What if I change my mind?

Purchases made online/over the phone:

Pay Monthly Phones

In the unlikely event that you want to return your phone (including promotional items if applicable), you will need to let us know within 7 working days of the date of delivery (not including the day of delivery). You will then have another 7 days to return the purchase to us.*

To discuss the return you will need to call 08448 712234 option 2, our Account Managers can discuss this with you further. They are open Monday - Saturday and 9am - 5pm. You can call 08002 946039 Monday - Friday 5pm - 6pm.

Your products must be returned to Phones 4u undamaged with all accessories (including any products supplied as part of a promotion) and where possible the original packaging. Just keep your receipt and you will only get charged for the line rental used and any calls made if you're on pay monthly.

Once we receive your product and have made sure everything is in good condition we will make a request to your selected network provider to terminate your deal and will sort out any refunds within 10 - 14 working days.

*We do not operate a returns period for Pay Month Upgrades, however, if you are unhappy with the handset selected, then we are able to discuss a potential exchange (this only applies to Pay Monthly Upgrades taken out online or over the phone with our Sales Team)

Pay as you go phones

In the unlikely event that you want to return your phone (including promotional items if applicable), you will need to let us know within 7 working days of the date of delivery (not including the day of delivery). You will then have another 7 days to return the purchase to us.

We can arrange for the item to be returned using a pre-paid Royal Mail bag. To do this you'll need to contact our Live Chat Team in the support area of our website.

Your products must be returned to Phones 4u undamaged with all accessories (including any products supplied as part of a promotion) and where possible the original packaging. Just keep your receipt and you will only get charged for the line rental used and any calls made if you're on pay monthly.

Please note, if you have purchased a pre-pay handset with airtime included, you will only be entitled to a refund for the cost of the pre-pay handset and not the SIM card and mobile phone airtime credit. When returning your handset you should keep your SIM card as this will still have the airtime that you have purchased.

Once we receive your product and have made sure everything is in good condition we will make a request to your selected network provider to terminate your deal and will sort out any refunds within 10 - 14 working days.

Purchases made in store:

Pay Monthly Phones, Broadband Dongles and SIM Only Contracts

Phones 4u does not operate a 14 day return period on Pay Monthly Contracts. Contract handsets, however, may be returned within 14 days of the date of sale if the network coverage is considered to be poor at the customers contractual address and no alternative network agreement can be established. Cancellation is subject to network provider approval.

Pay as you go Phones

Please return your phone to your nearest Phones 4u store where we will be happy to provide you with a refund or a like-for-like exchange should your product be faulty within the first 28 days from the date of purchase. Please note that where a refund is provided this will be in respect of the handset price only and cannot be provided for any airtime which has been topped up on the handset, so make sure you keep your SIM card.

SIM Free Phones

Phones 4u does not operate a 14 day return period on SIM Free phones.

2.What if my goods don't work?

Fortunately, this doesn’t happen very often. If it does, you can be sure that we’ll be there to help you.

FAULTY* GOODS RETURNED LESS THAN 28 DAYS AFTER YOUR DATE OF RECEIPT

All goods come with 28-day unlimited technical support. If you experience any technical issues with your goods please call our technical team Monday to Friday 9am – 10pm, Saturday 9am – 8pm, Sunday 10am – 6pm on 0844 871 2234. Calls are charged at 5p per minute from a BT line, mobile and other network providers may vary.

If our technical team are unable to assist with your enquiry:

Goods connected with pay monthly contracts

  1. contact the Phones 4u Direct Support Team on 0844 871 2234, who will advise of your return options.
  2. once we have received the goods (including charger, battery, accessories, instruction manual and any other items we originally sent to you) in as good a condition as they were when they were delivered to you, and where possible returned in their original packaging, we will arrange for a like for like exchange product to be sent to you.**

Prepay or standalone goods

  1. contact the Customer Support Team on 0844 871 2234, who will advise of your return options.
  2. once we have received the goods (including charger, battery, accessories, instruction manual and any other items we originally sent to you) in as good a condition as they were when they were delivered to you, and where possible returned in their original packaging, we will arrange for a refund or a like for like exchange product to be sent to you. **

All goods are supplied with at least a 12-month return to manufacturer warranty. If you experience any faults with your goods following 28 days from the date of your purchase then please either contact us on 0844 871 2234 or the manufacturer direct. Where there are circumstances which have reasonably prevented the return within 28 days we will happily provide a like for like exchange**

In most cases accidental damage can be repaired but there will be a charge to do this as accidental damage is not covered by the warranty, if you wish us to, we will gladly arrange a repair for you.

**the right to return goods applies to the goods only and will not entitle you to terminate your airtime contract with your network provider.

3.IMPORTANT - Terms & Conditions

  1. Where a refund is provided, this will only be given in respect of the price paid for the goods cannot be provided for any airtime and you should retain your SIM card to use any airtime purchased with the goods.
  2. You will remain responsible for any pro-rated line rental, data and network charges for the period of time the goods were connected to the network.
  3. If you paid a deposit when you originally connected, this will have been paid directly to your network. For this reason we are not able to refund this to you. However, if you contact your network then they would be pleased to help
  4. All exchanges are subject to stock availability.
  5. We will not exchange, refund or repair items where there is evidence of customer mis-use accidental damage or moisture/liquid damage.
  6. Where possible, goods must be returned with the original and intact packaging.
  7. Our policies do not affect your statutory rights.

13. T-Mobile PAYG Price Plan Changes

The following changes will take place on T-Mobile Pay As You Go price plans from November 28th 2011.

  • Per minute billing:
    We’ll be simplifying our call charges by moving to per minute billing. This means all calls from Nov 28th will be charged rounded up to the nearest whole minute. For example – a call of 2 minutes and 10 seconds will now be charged as 3 minutes.
  • 1p SMS standard: The cost of an SMS on your price plan will now be increasing by 1p.
  • 1p SMS XNet (WAP version 5): The cost of an SMS to any other network on your price plan will now be increasing by 1p. All texts to T-Mobile customers will remain at 6p.
  • Spearhead: The cost of a voice call on your price plan will now be increasing by 5p
  • For all customers affected we will focus on the new trident plans and their benefits as opposed to the price changes.

14. Upgrade Price Promise

Upgrade Price Promise Terms and Conditions.

  • Upgrade Price Promise: If, as part of a pay monthly upgrade, you find a cheaper price for a handset with a competitor, on the same tariff and terms as offered by Phones 4u, then we will match the price of the handset.
  • Qualifying Tariffs: This applies to consumer pay monthly upgrades only, and excludes SIM-free handsets, PAYG, business, or new connections and any 'gift-with-purchase' or cashback offers.
  • Competitors: this means Carphone Warehouse, O2, Orange, T-Mobile, Vodafone and Virgin Mobile retail and online stores.
  • Comparing online & in-store deals: we will only match our online prices against competitor online prices and store prices against competitor store prices. We cannot match online prices in our retail stores and vice versa.
  • Matching individual deals: we can only match published handset prices. We cannot match any variations to these advertised prices (e.g. variations offered directly to individual customers).
  • Like for like comparison: the handset and tariff being compared must be identical (e.g. same duration, monthly cost, inclusive minutes/texts/data, same make, model, design & network), must be in stock and subject to the same terms of sale (e.g. delivery/warranty).
  • Proof: you must provide proof of the cheaper price which is satisfactory to Phones 4u.
